1. Schutz personenbezogener Daten
Personenbezogene Daten, sind Daten, die die Identifizierung einer Person zulassen. Dies sind unter anderem der Name, die Adresse, das Geburtsdatum und die IP-Adresse.
Wir (MH Rechtsanwälte OG) nehmen den Schutz und die Sicherheit Ihrer persönlichen Daten sehr ernst. Die Bearbeitung Ihrer personenbezogenen Daten erfolgt daher ausschließlich im Falle Ihrer ausdrücklichen Einwilligung oder wenn eine sonstige rechtliche Grundlage (im Sinn der DSGVO) vorliegt. Es werden nur solche personenbezogenen Daten erhoben, die für die Durchführung und Abwicklung unserer Aufgaben und Leistungen erforderlich sind oder die Sie uns freiwillig zur Verfügung gestellt haben.

3. Ihr Recht auf Auskunft und Löschung (Betroffenenrechte)
Sie haben das Recht auf Auskunft über ihre gespeicherten, personenbezogenen Daten, deren Herkunft und Empfänger und den Zweck der Datenverarbeitung, sowie ein Recht auf Berichtigung, Widerspruch, Datenübertragung, Einschränkung der Bearbeitung sowie Sperrung oder Löschung unrichtiger/unzulässig verarbeiteter Daten.
Sie haben auch das Recht, eine allenfalls erteilte Einwilligung zur Nutzung Ihrer personenbezogenen Daten jederzeit zu widerrufen. Zur Geltendmachung der Ihnen zustehenden Betroffenenrechte (Auskunft, Löschung, Berichtigung, Widerspruch und/oder Datenübertragung[1]) wenden Sie sich an michi(at)mhattorneys.at.
Sofern Sie der Auffassung sind, dass die Verarbeitung Ihrer personenbezogenen Daten durch uns gegen das geltende Datenschutzrecht verstößt oder Ihre datenschutzrechtlichen Ansprüche in einer anderen Weise verletzt worden sind, besteht die Möglichkeit, dass Sie sich bei der zuständigen Aufsichtsbehörde beschweren. Dies ist in Österreich die Datenschutzbehörde.

4. Verwendung von Daten – Sicherheit
Die uns zur Verfügung gestellten Daten werden nur für eindeutig festgelegte oder durch Ihre Einwilligung gedeckte Zwecke verarbeitet. Die Erhebung der Daten erfolgt im Rahmen von Bestimmungen, die die Vertragsanbahnung unterstützen oder einen bereits geschlossenen Vertrag abwickeln sollen und die im Einklang mit der DSGVO stehen. Davon ausgenommen ist die Nutzung für statistische Zwecke, sofern die zur Verfügung gestellten Daten anonymisiert wurden. Sofern wir Ihre Daten für einen anderen Zweck weiter zu verarbeiten beabsichtigen, so stellen wir Ihnen vor dieser Weiterverarbeitung Informationen über diesen anderen Zweck und alle maßgeblichen Informationen gem. Art. 13 Abs. 2 DSGVO zur Verfügung.
Wir haben dem Stand der Technik entsprechende organisatorische und technische Vorkehrungen getroffen, um den Schutz Ihrer personenbezogenen Daten zu gewährleisten (Schutz gegen missbräuchliche Verwendung sowohl von innen als auch von außen (etwa durch Firewalls, Verschlüsselungen, Zugriffsberechtigungen, etc.). Es kann jedoch nicht ausgeschlossen werden, dass durch von uns nicht verursachte Fehler bei der Datenübertragung oder auch unautorisiertem Zugriff durch Dritte (Hacker, etc.) Informationen von anderen Personen eingesehen oder genutzt werden. Dafür übernehmen wir keine Haftung, sofern diese missbräuchliche Verwendung nicht von uns schuldhaft verursacht wurde.
Es ist empfehlenswert bei der Versendung besonders sensibler Daten und Informationen den Postweg zu nutzen, da bei der E-Mail Nutzung eine Sicherheit nicht gewährleistet werden kann.
5. Weitergabe von Daten an Dritte (Übermittlung)
Grundsätzlich stellen wir Ihre personenbezogenen Daten dritten Parteien nicht zur Verfügung. Allerdings kann es zur Erfüllung Ihres Auftrages oder aus gesetzlichen Gründen erforderlich sein, Ihre Daten an vertrauenswürdige Dritte weiterzuleiten. Dies können Gerichte oder Behörden oder sonstige beteiligte Dritte (auch Auftragsverarbeiter, die für uns tätig sind) sein. In diesem Fall erfolgt die Weitergabe Ihrer Daten ausschließlich auf Grundlage des DSGVO (aufgrund der von Ihnen erteilten Einwilligung, zum Zwecke der Erfüllung eines Vertrages oder der Erfüllung einer rechtlichen Verpflichtung, etc.).
6. Speichern/Löschen von Daten
Wir bewahren Ihre personenbezogenen Daten nicht länger auf als es für die Zwecke, für die sie verarbeitet werden, erforderlich ist. Die Aufbewahrung der Daten erfolgt auch zu Beweismittelzwecken unter Berücksichtigung der Verjährungsfristen bzw. solange eine Inanspruchnahme (Haftung) von uns möglich ist.
7. Wir verarbeiten Ihre Daten auch zum Zweck des Eigenschutzes (Schutz des Eigentums sowie Mitarbeiterschutz und Wahrnehmung von Verkehrssicherungspflichten) sowie zum Zweck der Verhinderung und Aufklärung strafrechtlich relevanten Verhaltens in Form einer verschlüsselten Videoüberwachung. Die Auswertung der Daten erfolgt ausschließlich für diese Zwecke. Die Daten werden bis zu 72 Stunden gespeichert, eine längere Speicherung erfolgt nur im Anlassfall für die Dauer der Abwicklung des Verfahrens. Ihre Daten werden nicht an Empfänger weitergegeben, die mit diesen Daten eigene Zwecke verfolgen, sondern nur an zuständige Behörden und Gerichte (aus Gründen der Beweissicherung oder zur Durchsetzung von Ansprüchen), an Versicherungen (zur Abwicklung von Versicherungsfällen) und an Rechtsanwälte und sonstige Stellen zum Zwecke der Rechtsdurchsetzung. Eine Übermittlung an Empfänger in einem Drittland oder an eine internationale Organisation ist nicht vorgesehen. Ungeachtet der Ihnen zustehenden Betroffenenrechte (vgl. Punkt 3. Betroffenenrechte) ist darauf hinzuweisen, dass hier kein Recht auf Datenübertragbarkeit besteht.

Personal data, are data that allow the identification of a person. These are, among others, the name, address, date of birth and IP address.
We (MH Rechtsanwälte OG) take the protection and security of your personal data very seriously. The processing of your personal data is therefore only carried out with your express consent or if another legal basis (in the sense of the DSGVO) exists. Only such personal data is collected that is necessary for the execution and processing of our tasks and services or that you have voluntarily provided us with.

3. your right of access and deletion (data subject rights)
You have the right to information about your stored personal data, its origin and recipients and the purpose of data processing, as well as the right to correction, objection, data transmission, restriction of processing and blocking or deletion of incorrect/impermissibly processed data.
You also have the right to revoke any consent you may have given to the use of your personal data at any time. To assert your rights as a data subject (information, deletion, correction, objection and/or data transmission [1]) please contact michi(at)mhattorneys.at.
If you are of the opinion that the processing of your personal data by us violates the applicable data protection law or that your data protection rights have been violated in any other way, you may complain to the responsible supervisory authority. In Austria this is the data protection authority (https://www.dsb.gv.at/).
4. use of data - security
The data made available to us will only be processed for clearly defined purposes or purposes covered by your consent. The collection of data is carried out within the framework of provisions which support the initiation of a contract or which are intended to process a contract which has already been concluded and which are in accordance with the DSGVO. This does not include use for statistical purposes, provided that the data provided has been made anonymous. If we intend to further process your data for another purpose, we will provide you with information about this other purpose and all relevant information in accordance with Art. 13 Para. 2 DSGVO prior to this further processing.
We have taken appropriate organisational and technical precautions in accordance with the state of the art to ensure the protection of your personal data (protection against misuse both internally and externally (e.g. through firewalls, encryptions, access authorisations, etc.). However, it cannot be ruled out that information may be viewed or used by other persons due to errors in data transmission not caused by us or unauthorized access by third parties (hackers, etc.). We assume no liability for this, unless this misuse was culpably caused by us.
It is recommended to use the postal service when sending particularly sensitive data and information, as optimum security cannot be guaranteed when using e-mail.
5. transfer of data to third parties (transmission)
As a matter of principle, we do not make your personal data available to third parties. However, it may be necessary to pass on your data to trustworthy third parties in order to fulfil your order or for legal/legal reasons. These may be courts or authorities or other third parties involved (including processors working for us). In this case, your data will be passed on exclusively on the basis of the DSGVO (on the basis of your consent, for the purpose of fulfilling a contract or fulfilling a legal obligation, etc.).

We also process your data for the purpose of self-protection (protection of property as well as employee protection and performance of traffic safety obligations) and for the purpose of prevention and clarification of criminally relevant conduct in the form of encrypted video surveillance. The evaluation of the data is exclusively for these purposes. The data will be stored for up to 72 hours, longer storage will only take place in the event of an incident for the duration of the proceedings. Your data will not be passed on to recipients who use this data for their own purposes, but only to competent authorities and courts (for reasons of preservation of evidence or to enforce claims), to insurance companies (to process insurance claims) and to lawyers and other bodies for the purpose of legal enforcement. A transfer to recipients in a third country or to an international organisation is not intended. Irrespective of the rights of data subjects to which you are entitled (see point 3. Data subject rights), it should be pointed out that there is no right to data transfer here.
Notes on data processing in connection with Google Analytics
This website uses Google Analytics, a web analytics service provided by Google Ireland limited. If the person responsible for data processing on this website is located outside the European Economic Area or Switzerland, Google Analytics data processing is carried out by Google LLC. Google LLC and Google Ireland Limited are hereinafter referred to as "Google". When using Google Analytics, data processing is technically provided by Jimdo. In this respect, reference is hereby made to Jimdo's privacy policy.
